I called Paddock and spoke with Andrew about the problems with the pool. He said a tech would be out on Wednesday, July 16.
He notified me that the 2 year warranty was up as of 03-2008. I wonder where they got that date because the actual completion date was 04-26-2006 per Ed Ghiz.

He told me there will be a $65.00 service charge for the repairs.

Replaster Started

DSC00068Prado and Sons came out and started chipping away at the plaster. They are removing the plaster from around all the fixtures and along the top edge. They will then apply a adhesive layer and then a finish coat.
I called Debbie Moles and was wondering why they were going to refinish the pool before repairing the waterfall and fiber optics.
She called me back and said that she called Prado and had them wait to finish till all the other work has been completed.
The fiber optics should be installed on Thursday or Friday. Allen tile will be out Friday at 8 am to look over replacing the stucco with tile.

She called back and left a message stating that they are waiting on the tile guys to give them an estimate on Tuesday about tiling the stuccoed part of the waterfall. Nick with the fiber optics will then repair the lighting. Once the waterfall has been completed they will do a multi coat on the interior of the pool.

Debbie Moles returned my call, and that she would try and have me the time schedule by the end of the week. She said that she is trying to schedule times for the repairs.
She needs to schedule Dave with Prado to try and spot acid wash the step with the footprint. If he is unable to remove it then they need to resurface the pool.
She contacted Pentair to see if they can figure out the heater.
They need to remove the water sheer, and install a larger sheer. They have already remeasured the area. She is unsure of when they will be able to install the new sheer until the interior of the pool is decided.
The peeling stucco will also be replaced at that time.
I told her that all work needs to be completed before March 31st. She stated that all the work should be done before it gets warm, but would not give a date.

Kimberly called to check if I had been contacted by the heater repair people. I told her that the last time I had heard from anyone was last week.
She said that they would like to wait till fall to repair the main drain. If they were to do an acid stack on the main drain, it would take 72 hours till anyone could swim. I asked her why they couldn’t do it now. The cleaning system wont work correctly and the bottom is staining worse than it already is. She will have to get with the service people to see if it can be done sooner. I asked her about the dirt staining that has been there since they installed the plaster. They have already acid washed it once. I have a footprint on the first step, dirt embedded into the plaster and streaks down the sides. The only thing the last acid wash did, was to make the plaster rough and splotchy. Wouldn’t it be better to fix the drain at the same time they have to fix the stained plaster? She said she would have to get with Edward about this and get back to me. She asked that I give her till Wednesday to call me and let me know what they are going to do.

Scott Dilliam was out to look at the cleaning system. I showed him the air bubbles coming out of the cleaning nozzles on the bottom of the pool. He said that was fine. The cleaning system is still not working. I mentioned that the auto fill was still running, and he said that he had raised the level of the water so it was just filling to catch up.
Debbie Moles called, she was under the impression that the lights were done. I also reminded her that if they have to acid wash the plaster, it would set back the installation of the salt system. She said she will contact the electricians, Terry with orientation, and Scott Dilliam in the morning and find out where we are at. I again stressed how important that we not go past the one year mark on this pool.

The electrician repaired the incorrectly wired pumps. He also said that the pool lights were also wired wrong and he fixed that also. He said they also installed the wrong lights in the pool. The color wheels can not be synced together, only one light has the auto sync feature the other light is a standard light. While checking his paperwork he also noted that they had installed Jazz lights, his paper calls for F/X lights. The F/X is a lower output lamp, and on a pool this size why lower output lamp? My contract states Jazz lights. So he needs to call and have a diver come out and replace the lights with the correct ones. They will not be able to operate the lights independently of each other the way they are wired and he doesn’t know if they will be able to sync colors with the fiber optics. According to Fiberstars, http://www.fiberstars.com/, all their lighting should be able to sync with each other assuming you get the right ones.
Jesse with Poco Verde called and said they are not able to seal the wok pots till the fiber optics are done in the pots.
Paddock came by to touch up the chips, stains, and cracks. He looked over the deck and said that he could do the repairs but since the construction was not finished, as he was told, he wanted to wait. He said that he would need to pressure wash and repaint the whole deck. I agreed that we need to wait because they still need to move rock and dirt across the deck.
Prado and Sons Plaster called and will be out on Tuesday to look over the stains in the plaster.
Water level down over 1/2″ since I turned off auto leveler. Pumps did not run all last night because the U/V system was installed.

Debbie Moles called and I gave her the list of things yet to be done. She was under the impression it was complete. She is going to schedule the electricians to figure out the lighting, fiber optic people, Poco Verde to seal the wok pots, Allen Tile to clean up the tile, the deck cleanup, and the plasterer to fix the stains. I am going to give them till the end of March to finish the project, at that time I will have no further contact with them.

Debbie Moles called and said that they are ready to plaster. She wants me to sign an addendum stating that everything is fine. She said that Scott had been out and the cracks are just surface cracks, nothing to worry about. I asked if he was looking at the same ones I saw. She will get back to me on this. I also told her about the water bib in the back that no longer works and that the construction crew has been using the neighbor’s water for their work. She stated that the fiber optics line for wok pot 3 will be put into flex conduit. They did not like to use flex due to it is hard to run the line inside it. (Like being poured inside concrete is easier to pull?) I e-mailed Debbie Moles the pictures of the cracks I saw.

Debbie,
I am sending you a couple pictures of the cracks I talked with you about on Wednesday. They are located on each side of the waterfall, flanking the sides of the tile.

The back hose bib that is connected to the automatic fill system is dead. I have not checked to see if it is the hose bib itself or if there is no water to that line anymore.

I also noticed where the waterfall meets the pool, the deck has chipped and cracked. I know these will be taken care of later when they come to finish the deck but I just wanted you to be aware of them.
So as I see it we are currently going to wait on the fiber optics for both the water sheer and the wok pot till after the pool has been plastered and filled. Then the deck and the wok pot base can be repaired, gate for equipment area re-hung, exterior yard wall capped and finished, planter refilled with dirt, salt system added, pressure gauge on cleaning system repaired, diving board, Jazz lighting controller, fiber optic controller and illuminator, and remote light/pump controller, will be installed at a later date barring any other problems don’t pop up.

I told her about the sheer not having the lip to mount the optics on. She will confirm this with Scott. Scott is working on the sheer lip and plans to cut the tile back.

Poco Verde called and told us that they were going to try and file for the wall permit today. Debbie Moles called and said that the plumbers would be out Thursday to set the sheer. Footer for the planter was dug by Poco Verde. Several pipes for the pool were broken when the footer was dug down to proper depth. Pipes are about 6” below the ground and the footer will now go over and around the plastic pipes.

Poco Verde arrived and started demolition on planter. They removed all 4 walls of the planter including the water sheer. Talked with Debbie and she said that they needed to start over with all 4 walls. I also told her that it looked as if they hit some of the pool water lines that were under the planter.

Debbie Moles called to let me know that the starting date would be Tuesday the 17th of January, so all work should be complete by February 15, 2006. She needed to get in touch with the ROC inspector to verify the complaint had been canceled. Scott and Bob would be out Monday to look over everything that needs to be redone. The wok pot risers would be started on Tuesday and the wok pot fountains would be complete by Wednesday. Demolition would start also on Tuesday.

Debbie Moles called to let me know that the inspector for Paddock (Gene) was out today to look over the project. She stated the he agreed that the walls were the worst he had seen and needed to be replaced per plan. She offered 2 plans of action.
• Plan 1. Issue money back on the planter and offer a 2 year warranty.
• Plan 2. Fix it per plan with a 30 day extension for time needed to rebuild the planter and waterfall. After 30 days, they will pay $50.00 in cash per day in penalties up to $500.00. The 30 days do not include the time needed to plaster and the pool startup.
Both plans require I close the complaints with the R.O.C.
I asked her if the wall that needs the permit would also be included since it was cracking and falling down. She seems to think that would not be a problem but had to check with Nancy Graham and would let me know if it would extend the 30 day time limit.
I agreed to the second plan and she will fax me the addendum.
The wok pots and concrete risers will be fixed Monday or Tuesday.
The addendum will not include the side property wall due to it was not included in the ROC complaint. But they would fix it if needed.

Debbie Moles faxed over addendum #47525 that states 3 walls of the planter will be rebuilt to plan. They will have 4 weeks to finish the work.

Debbie Moles called to check status. They started on the tile for the waterfall face. Wrought iron fence panels were placed and welded in. Tile on the waterfall was placed all the way to the top of the waterfall on both sides of the sheer, leaving no room for the saltio tile across the top.

Debbie Moles called to check status but I had not been home yet to see if anyone had been working. Water sheer raised and capped by sheer installers. The tile gap between the wok pot bases and the waterline tile was filled in with approximately 1” of tile grout. It was then shaped to look like the permadeck.

Chris from Poco Verde called for an exit survey. I told him I was not at all happy with their performance. Plus I did not realize they were done since many things were not complete. The planter has not been water sealed. The tile is still 2” above the water sheer. Nail holes still not patched. Wok pots not placed. Basically the entire check list has not been completed.

I spoke with Debbie Moles and informed her that nobody had been out to work since Thursday. She asked if I had met the new superintendent Kevin Thompson yet. She would make some calls and call me back on when they may start work again.
I e-mailed both David Reiter and Nancy Graham about the delays.
Received e-mail response from Nancy Graham:

Debbie in our Quality Assurance department monitor your job. Debbie has been working with Scott Dilliam and Bob at Poco Verde regarding all the repairs. Scott is making some repairs on the feature, Scott and Debbie want to make sure this is correct as it is not just a standard pool. Scott is waiting for Fiber Optics to make changes which happened last Thursday. Scott Dilliam will make sure all the pool is up to both our standards. looks like you are at the finishing phases.

Debbie advised me she has been in contact with you almost daily, anytime you have a custom design pool it can require more attention, it is more important to get it done correctly and make the changes at this point. Debbie also stated that we have had more than normal challenges with Poco Verde.

Debbie also said you have been very patient and we are truly sorry it has taken this long. Debbie will stay on this until it is done and you are 100%. Scott Dilliam is one of our best supervisors, he will also stay on top of making sure poco verde has to finish around the sheer as we can not get tile around planter wall then we can do tile work. We will stay on top of poco verde to make sure this gets done. You are literally weeks away from being completed.

Again we will stay in touch, Debbie will be checking with you and communciating as we committed to building you a beautiful pool. You do have very complicated pool (not out of our realm) but it does take time.

Debbie Moles called at 4:10pm and said that Poco Verde would be out on Tuesday. She stated that the pool would be ready for tile the first of next week. I reminded her that the waterline tile still needed to be redone due to the gap at the top of the wok pot bases, number 3 on the list of concerns, and the missing random tiles, number 4 on the list of concerns. I also pointed out that the water sheer was supposed to meet the 5” tile fascia, but they had left a 2” gap, number 7 on the list of concerns. Fix the concrete lines showing on the pot risers, number 6 on the list of concerns. She wanted to set up a meeting for me and Scott Dilliam. I told her that I have met with him several times and have left him lists and drawings to no avail. She will meet with him Tuesday and let me know what they are going to do. At this point I am so disappointed in the pool I just want it to be done.

Fiber optic people started on adding fiber to waterfall. They cut out the wall from the misplaced conduit to where it was supposed to be, chiseling a line inside the waterfall wall. I spoke with Debbie Moles and told her about the nail holes in the face of the waterfall that Poco Verde was going to repair before painting but did not. I also asked her about the fiber being embedded into the wall. She said that the nail holes would be fixed and that the fiber optics would never be a problem in the wall. She asked me to e-mail her some current pictures of the planter.

Work on the wall continues. They painted the planter walls. Spoke with Debbie Moles about 4:00pm. I told her about the waterfall being too low and she said that the original pictures from Paddock where artist concept pictures and may not be exactly what is installed. Told her I would like to meet with her and or Scott Dilliam to discuss the planter waterfall. She would get a hold of Scott and let him know.

Work on the wall continues. Backyard interior wall that Poco Verde replaced was painted white.
Talked with Debbie Moles and told her about my concerns on the uneven planter wall. She called back around 1:40 and said that Scott Dilliam and Chris from Poco Verde would be out around 2:30 to 3:30 to discuss the problem with me.
At 2:30 Poco Verde showed up and I showed him the drawing I had verses the current layout. The equipment wall not level, tile only 8” wide on the side wall tops, the waterfall 1 brick row below the top, the fiber conduit way below the waterfall, and that the planter had not been fully sealed. He said they would seal the planter today, talk with Scott about the placement of the waterfall and conduit, and level the top of the equipment wall with stucco. Redo the stucco on the planter before painting it and then painting it around Friday. He said that Poco Verde would warrantee the wall from further cracking, and if it did crack they would repair it. I asked for this in writing and he said he would get me a copy. He said he would have to check his drawings about the tile widths, capping the planter walls. The side caps were 8”, the same thickness as the bricks, and could not be larger due to the tile being too brittle to hang over. As for the waterfall cap, he could credit the cost if his drawings showed 2 rows. I told him I prefer 2 rows of tile as in the drawing I have. He was waiting for the fiber optics to be plumbed before he can set the wok pots.

Pictures 001, 002, and 003 are the original design pictures I received when we purchased the pool on March 26, 2005.
Picture pool was altered to the way it needed to be built due to diving pool specs, fitting it into yard, and visual appeal. Mr. Anderson and I reviewed the final plan on April 15, 2005.

Picture DSC00001 shows a couple of things. First the waterfall front does not continue onto the deck as shown in picture 001, where the tile lines up with the pool deck tile line. At this point I could live with that. The unevenness of the back wall.
Picture DSC00010 shows the tile layout. The side tile has been cut to wall thickness. The waterfall tile has not been cut yet.
Picture DSC00011 shows the waterfall is set too low into the wall. The water was to look as if it was just blow the tile. The electrical conduit is way to far from the sheer. Instructions for placing the lightbar can be found here:

Debbie Moles called at 11:30am and said Lloyd Wilson was being replaced by Scott Dilliam for now. I told her about the water seeping into the pool from the planter. She said Scott would be out soon to look over the project. She also said Poco Verde was waiting for ‘sheening’ (sheer?) till the top cap could be placed on the wall and that was why the last brick has not been placed.
I met with Lloyd Wilson and Scott Dilliam at 1:15pm. I asked about the top of the wok pedestals being covered with decking and stamped like tile. He said that was the plan. Lloyd said they had to upgrade the waterfall pump to a 2 ½ hp due to the size. He said they were going to float the decking in front of the wok pot pedestals to eliminate the gap in the tile. Poco Verde told him that they could straighten out the wall with stucco. Scott is going to meet with them to discuss what they are going to do about the wall. Heat pump still needs to be connected, pump bases need to be sturdy, fiber optic for wok pots and sheer all still need to be addressed. I was told that the farthest run for fiber optic was about 35 feet and the illuminator could not be moved. He asked about the self closing gates. I reminded him that Paddock was to supply the wrought iron fence and gate. Lloyd was concerned about the 5’ fence requirement since the wok pedestals were close to the common wall. But since we are in Gilbert it should not be a problem.

Debbie Moles called about the wall. I told her it is still not completed. A crack developed from top to bottom, just right of the planter. It looks as if it had been repaired, or at least attempted.

Tile Tomorrow?

I met with Lloyd Wilson at 9:30am. I told him about the tile only having one color. He checked the plans and confirmed it was to have a random tile approximately every 3 feet. He said he would have them add it. If I wanted to leave it one solid color tile I could contact the salesman, and they could credit the cost of the second tile. I decided we would go with the original plan due to I want nothing to do with the sales end of it anymore. He said the tile on the raised bases needed to be redone due to a large gap at the top of the bases. Poco Verde was to be out with the wok pots so that could be done. Fiber optic illuminator had to stay on the outside of the pool equipment wall due to fiber length constraints.
3:00pm Debbie Moles called and said Poco Verde would be by to work on wall tomorrow. I told her they had started on it today. They had removed the top 2 rows of bricks on half the wall. She was also under the impression they were to replace the wall, not just straighten the top rows. Lloyd Wilson assured her the wall would be perfect when completed. I also mentioned to her that the tile people had broken off a chunk of deck at the first wok pot base, and that the planter was still not sealed correctly. I had spoken with the man from Poco Verde that is working on the wall, he stated that the planter was all sealed and he was returning tomorrow to tile. I am unsure of what he is going to tile since nothing is correct enough to tile yet.

I met with Lloyd Wilson at 9:30am. He looked over the deck and checked the planter wall. He agreed that it was crooked.
Debbie Moles called and said there was a work order for the planter wall and heater repair. She stated that she had spoken with Scott Dilliam about the planter wall. She would call Poco Verde tomorrow. The heater manufacturer would need to come out to find the leak in the heater. I asked when the salt system would be installed. She said it was last to be installed.

Work on forming deck and wok pot areas.
9:00am Debbie Moles called to ask about progress. I told her that the framers had just left. I told her about the planter wall being stuccoed but still made of miscellaneous bricks. I also mentioned that the planter wall looked straight if you were really drunk. The pool heater still leaked, and the pump pads were still sunk in the dirt.
I did notice that the planter had been partially filled with dirt even though it had not been fully sealed. This raises future problems of water from the planter exiting thru the waterfall area.

8:00am I called Lloyd Wilson and told him the deck was formed too short, ending before it reached the fireplace extension of the house. He said they go from scale and he would be out to take a look.
9:00am Debbie Moles called to let me know that the fiber optics will be in by Tuesday. I told her also about the 4’ walkway missing, deck short, planter back wall short in height and length, and the planter not sealed enough to keep water from leaching into the pool. She said she would get with Lloyd and let me know.
9:20am Debbie called to say Lloyd would try and be out this afternoon.

Poco Verde worked on waterfall. I have several concerns about the waterfall/planter. First are all the gaps in the block. It is a planter full of dirt and will be irrigated. This will leak out into the stucco exterior. Second, looking at the back of the waterfall, it seems to be sagging in the middle. I checked level and it is off. Third is the stacking of the block. The block on the side of the planter is not staggered in some areas, leaving a weak area in the retaining wall. Since dirt and plants will be above the weak area, I see a potential failure in the future.

Nancy Graham at Paddock called to see if Poco had shown up today. They did this afternoon but when I looked out at 2pm they were gone.
Nancy is going to be gone the rest of the week so Debbie Moles will be following up on this for her. Poco is supposed to finish this week with the water features so that the deck can be poured on the 26th. But that can’t happen unless Poco finishes. Debbie will be checking in mid week to make sure Poco is showing up.

At 1:30, Bob from Poco called my wife. He said that they can’t find matching bricks for the fence. She told him that he would have to talk with David on his cell number about that.
At 2:00, Nancy Graham from Paddock called. She was returning David’s call from last week. She had talked with Bob about the fence and was told that they would be out tomorrow to start work on the fence, the water fall and the water pot walls. She wasn’t sure how long that would take to complete. But that we couldn’t do any additional work until it was completed. She thought that the fiber optics would be next and then the cool decking and tile.
She then called Lloyd to confirm that Poco was starting tomorrow. Lloyd and Bob are supposed to meet at our house tomorrow to go over the work one more time.
She will call me on Friday to check on the progress.

1:40pm Bob Owens called to inform me that the block would not match the old wall. He said they could get a block that closely matches or paint it to match if needed. I told him that would be fine. He said that he was told that some of the footings were incorrectly poured. He also stated that they would be out on Tuesday to meet with Lloyd Wilson and make sure of the wall and water feature placement. I mentioned that I had been told the wall would have been done much sooner. He said the paperwork was received only a month or so ago and they usually wait till the pool is poured.

She told my wife that the plumbers are out about 4 or 5 days. Graham asked if Poco had fixed the fence, was told not yet. She said she would call Bob Owens and get them out on Wednesday, and she would call if they were unable to do it. She was informed that the payment was made today.

2:15pm transferred to Lisa. She said Poco Verde shows the wall to be completed by 07-18-2005, today. She is calling them to find out when it will be completed and call me back. They did not receive the plans from engineering until mid June. The original holdup was from paperwork and permits in the beginning.

2:38pm Bob Owens from Poco Verde called. He has no paperwork releasing funds for the project. Collecting info on the job, was wondering if we were to pay direct. He did not show adding the wall that was removed. He also had questions about the wall surfaces and tile. I reminded him the waterfall needed to be a retaining wall.

2:58 Nancy Graham called. Said Poco Verde has all paperwork needed to start. Will have wall started Monday 07-25-2005. I requested a schedule in writing on when the pool is to be completed. She will get me a copy ASAP. She noted they have been very busy and demand is high. Pool should take 12 weeks to complete. She said we had requested that the wall be installed before digging, I told her that was not the case, and just that it would be easier for Poco Verde to rebuild the wall before the hole was dug.

4:12pm Nancy Graham called with schedule. 07-19-2005 – will be out to re-lay the line. 07-20-2005 – Mike Maez will be out to check layout. 07-22-2005 – excavating will begin. 07-25-2005 – Poco Verde will be out to put back up the wall. Once excavating is complete, poll will be finished in 12 weeks. She is e-mailing me a copy of the schedule.

9:45am Paul Elkins arrived said he could not layout the pool until the fence and trees were removed.

10:05am My wife called Shirley Thompson and explained this to her. Shirley Thompson said she only showed 2 stumps to be removed from the pool area. She was going to contact Jason Anderson and find out what to do.

2:00pm Mike Maez, 480-xxx-xxxx, came by. My wife showed him the fence and trees to be moved. Maez said he would have a demo crew out ASAP to do the demolition. Then right away have the fence contractor put in the new wall to secure the back yard. He marked with paint the location of the new wall. They talked about the planter behind the water feature and the wall needed to hide the pool equipment. The drawing we got from Paul Elkins did not look like it included these items. Maez said that Poco Verde would be installing them after the pool had been shotcreted. They also discussed tile patterns using different types of tile. He said they could not use Saltillo tile around the top of the water feature and Poco would come up with some ideas for us to choose from. She also asked him about the construction of the wok pot water features. Our concern was not being strong enough to support the weight of someone standing on it. He said it would be strong enough and would be made out of the same material as the pool.
